Rights under US State Privacy Laws
Overview
This page describes the privacy rights available to residents of US states with applicable consumer privacy legislation. It supplements our main Privacy Policy and provides the specific disclosures required under California's CCPA/CPRA and substantially similar laws in other states.
California's Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), provides the broadest consumer privacy protections among US state laws and sets the baseline for our approach. We apply these rights consistently to residents of all covered states, not just California.
Covered states
This page applies to residents of the following states, each of which has enacted comprehensive consumer privacy legislation:
- California — Consumer Privacy Act (CCPA) / Privacy Rights Act (CPRA)
- Virginia — Consumer Data Protection Act (CDPA)
- Colorado — Privacy Act (CPA)
- Connecticut — Data Privacy Act (CTDPA)
- Texas — Data Privacy and Security Act (TDPSA)
- Delaware — Personal Data Privacy Act (DPDPA)
Residents of other states where privacy legislation has been enacted or takes effect during the term of your account will be afforded the same rights on a best-efforts basis. If you are unsure whether your state is covered, contact us at team@dashboardfox.com.
Personal information we collect
In the 12 months preceding the date of this policy, we have collected the following categories of personal information about account holders and visitors:
We collect this information directly from you at registration and during use of the Service, automatically through cookies and analytics (with your consent), and from our payment processors in connection with billing. The full detail of what we collect and why is set out in our Privacy Policy.
How we use personal information
We use personal information collected from US residents for the following business purposes:
- Providing, operating, and improving the DashboardFox platform
- Processing payments and managing subscriptions
- Sending transactional communications (billing receipts, security alerts, service notices)
- Sending marketing communications to existing customers and trial users (you may opt out at any time)
- Detecting and preventing fraud, abuse, and security incidents
- Understanding feature usage and improving the product
- Complying with legal, regulatory, and tax obligations
We do not use personal information to make automated decisions that produce legal or similarly significant effects on individuals.
We do not sell or share your personal information
Because we do not sell personal information, the right to opt out of sale does not apply. We state this explicitly for transparency. Similarly, we do not share personal information for cross-context behavioral advertising, so the CPRA right to opt out of sharing does not apply either.
Your rights
Residents of the covered states listed above have the following rights with respect to their personal information:
Right to know
You may request disclosure of the categories of personal information we have collected about you, the purposes for which it is used, and the categories of third parties with whom it is shared. You may also request the specific pieces of personal information we hold about you.
Right to delete
You may request deletion of personal information we have collected about you. Some information may be exempt from deletion where retention is required by law — for example, billing records and tax data must be retained for 7 years. We will tell you if an exemption applies to your request.
Right to correct
You may request correction of inaccurate personal information we hold about you. Many corrections can be made directly from your account settings in the management portal without contacting us.
Right to data portability
You may request a copy of the personal information we hold about you in a portable, machine-readable format. Account owners can request a GDPR-standard data export by contacting us at team@dashboardfox.com.
Right to opt out of sale or sharing
As noted above, we do not sell or share personal information for advertising purposes, so this right does not apply in practice. You may still submit an opt-out request and we will confirm our non-selling status in writing.
Right to limit use of sensitive personal information (California)
California residents have the right to limit the use of sensitive personal information to what is necessary to provide the Service. We do not use sensitive personal information — such as account login credentials or two-factor authentication data — for any purpose beyond operating and securing your account.
Right to non-discrimination
We will not discriminate against you for exercising any of your privacy rights. Exercising your rights will not result in denial of service, different pricing, or a different level of quality.
How to submit a request
You may submit a privacy rights request by:
- Email: team@dashboardfox.com — include "Privacy Request" in the subject line and specify the right you are exercising
- Management portal: Account owners can action many requests (correction, deletion, data export) directly from account settings without contacting us
We will respond to your request within 45 days of receipt. If we require additional time to respond — for example, for complex or high-volume requests — we will notify you within the initial 45-day period and may extend our response time by a further 45 days, for a maximum of 90 days total.
We do not charge a fee to process or respond to a verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine a fee is warranted, we will explain why and provide a cost estimate before proceeding.
Verification
To protect your privacy and prevent unauthorized access, we will verify your identity before processing a deletion, access, or portability request. Verification is done by confirming that the request originates from the email address associated with your account. For requests submitted through the management portal, authentication serves as verification.
We will not require you to create an account to submit a request, but we may ask for information sufficient to verify your identity where no account exists in our system.
You may designate an authorized agent to submit a request on your behalf. To use an authorized agent, provide written authorization from you to the agent along with your request. We may contact you directly to verify the authorization.
Non-discrimination
5000fish, Inc. will not discriminate against any individual for exercising their rights under applicable US state privacy laws. This means we will not:
- Deny you access to the Service
- Charge a different price or rate
- Provide a different level or quality of service
- Suggest that you will receive a different price, rate, level, or quality of service
